One million euros paid to a company after a Romanian truck with a trailer hit a driver in Italy who had stopped to change a tire

​The man died and the insurer RCA Omniasig gave the money to the victim’s heirs.

In 2022, “a truck with a trailer hit the driver of a car stopped in the emergency lane to change a tire, causing his death,” said insurance company Omniasig.

“Moral damages were requested by the victim’s heirs, and the case was paid with over 5 million lei and completely closed in 2023”, according to the insurer.

This is the second largest RCA insurance paid last year in Romania. The first one reached 18 million lei and came after a tragic accident with a Romanian truck in France.

Another case, from Bucharest, was compensated with over 800,000 euros

The third highest amount paid in 2023 by the same insurer is over 4.28 million lei for a 43-year-old driver from Bucharest, who was left without both legs.

“The driver of the guilty car did not give priority to the car that was traveling on the road with priority, thus causing serious bodily injury to its driver.”

In this case, it was a road event in 2017 resulting in the serious bodily injury of a 43-year-old person who suffered a permanent physical disability.

“The case was settled in court on the basis of the RCA insurance issued by Omniasig and moral damages, material damages (costs related to prostheses, medical expenses, etc.) and periodic monthly benefit as a result of the loss of work capacity were awarded”, he added stated the insurer.

By its legal definition, car civil liability insurance (RCA), mandatory for any car owner, has two purposes: the financial protection of the person responsible for the accident as well as the financial protection of the person, the persons damaged, following an accident.

Based on this contract, the insurer that issued the RCA insurance pays compensation to third parties damaged as a result of an accident caused by the vehicle for which the insurance was terminated, for material damages and/or death or bodily injuries, including moral damages, suffered in that accident.

Currently any RCA insurance, regardless of its price, can cover the payment of compensations of more than 6.07 million euros for bodily injury, moral damages and death, as well as maximum compensations of 1.22 million euros for material damage.
