The former head of DIICOT Daniel Horodniceanu, currently vice-president of the Superior Council of the Magistracy, won the case against the Vrancea Traffic Police, after he was caught by the radar at 169 kilometers per hour.

“The court notes that, indeed, the metrological verification report certifies that the cineometer device is appropriate from a technical point of view and without reconsidering its own practice in this matter, emphasizes that the concrete conditions in which the recording was made were analyzed (… ) it does not appear obvious that the target car was the one driven by the appellant throughout the duration of the recording parallel to the petitioner’s car, another vehicle also drove, which seems to be the one targeted by the speedometer during the recording“, it is stated in the reasoning of the decision of the Vrancea Court, cited by Fanatik.

Previously, Horodniceanu also escaped disciplinary action after the incident in the “You know who I am?!” category. that he had with the policeman who caught him driving in traffic and took his license for 90 days.

The Horodniceanu case, emblematic

In May of last year, Horodniceanu was filmed while apparently trying to intimidate the policemen who pulled him over in a commune in Iaşi county. The Road Traffic Agents had reproached him for overtaking them without signaling and for exceeding the legal speed limit.

A video, made public by the site Journalist.ro, captures the dialogue between Horodniceanu and the police, in which the prosecutor threatened them that he would complain to the head of the County Police Inspectorate and asked them if they knew who he was.

Horodniceanu: Sir, did I tell you who I am?

Policeman: Who are you?

Horodniceanu: I am Chief Prosecutor Horodniceanu from Organized Crime. Don’t you know me? Yes, why don’t you know me, where are you from, from Vaslui or Iasi?

When the police ask for the car’s documents and the RCA, Horodniceanu gives them his prosecutor’s ID, asks the policeman twice what his name is and harasses him by asking him to look up the RCA license on the Internet.

Horodniceanu: Stop this nonsense, I told you, you don’t know who you’re talking to. (…) You are very scrofulous about debt, I see. What are you doing at this hour, patrolling the main street of a village? (…) I will talk to the head of the IJP (County Police Inspectorate) and see. (…) You stopped me because I had the nerve to overtake you, you do the same things with me that you do with any criminal.

In November 2023, the Section for Prosecutors of the Superior Council of the Magistracy decided to reject the disciplinary action of the Judicial Inspection against the prosecutor Daniel Horodniceanu, filmed while apparently trying to intimidate the policemen who pulled him over in a commune in Iasi district.

Later, the Judicial Inspection filed an appeal against the decision of the Section for Prosecutors of the CSM to relieve prosecutor Daniel Horodniceanu of the disciplinary action, but the High Court of Cassation and Justice definitively rejected the action.
